Under 47 CFR 1.946 (click here) of the FCC Rules and Regulations, the FCC outlines the requirements for licensees to notify the FCC of the successful construction and operational status of new or modified licenses.  Licensees must 1) construct their authorized system or meet specific coverage requirements within a given time period and 2) notify the Commission that the requirement has been met. This time period varies depending on the radio service in which the license is held.

If a licensee fails to follow through on the notification, the FCC will AUTO TERMINATE (click here for FCC Website info) the license or frequency(s) involved

This action for public safety land mobile radio systems is scheduled to begin in the fall of 2005.

Determine your Buildout Deadline Date

The "construction, buildout, or coverage" deadline date is listed on the FCC license.  It may also be determined by accessing the FCC's ULS system: http://wirless2.fcc.gov/UlsApp/UlsSearch/searchLicense.jsp (click here)

Buildout requirements for public safety are typically 1 year from the grant of a license.   The entire license is affected if the grant is for a "NEW" application.  Only new frequencies are affected when added to an existing license such as in "MOD" applications.

Buildout Requirement Timelines

Below 700 MHz (except 220 MHz) Construct and place into operation within 12 months of license grant. IG, IK, YG, YK, PW, YW, RS 90.155 601 Main Form and Schedule K
700 MHz Interoperability Channels Construct and place into operation within 12 months of initial grant. SG, SY 90.551, 90.155(b) 601 Main Form and Schedule K
800 & 900 MHz Trunked (Excluding SMR) Construct and place into operation within 1 year of initial license grant. YB, YE, YF, YI, YJ, YO, YP, YU 90.631(e), 90.629 601 Main Form and Schedule K
800 & 900 MHz Conventional (Excluding SMR) Construct and place into operation within 1 year of initial license grant. GB, GE, GF, GI, GJ, GO, GP, GU 90.633(c), 90.629 601 Main Form and Schedule K
4940-4990 MHz (Public Safety 4.9 GHz) Fixed point-to-point stations, licensed on a site-by-site basis, must be constructed and placed into operation within 18 months of initial license grant. There is not a time requirement for base or temporary fixed stations. PA 90.1209, 90.155 601 Main Form and Schedule K
Intelligent Transportation Service, DSRCS Roadside Units Construct and place into operation within 12 months from the date of registration. IQ 90.155(i), 90.157(b) Exempt from Notification Requirement
